Bird Sales Terms & Conditions
Deposits
A deposit may be required to reserve a bird. Deposit terms are discussed and agreed upon before the reservation is made.
Deposits are non-refundable except if the reserved bird becomes unfit for sale due to illness, injury, or another condition materially affecting the bird's health or suitability for placement.
In such cases, the buyer may choose to receive a full refund of the deposit or apply the deposit immediately toward another available bird of the buyer's choice.
Seller's Right to Refuse or Cancel a Sale
What The Flock Bird Shop reserves the sole right to refuse or cancel a sale and refund any deposit or payments received if there is reasonable cause to believe that the bird would not be placed in a safe, appropriate, or humane environment, or if the placement would otherwise be contrary to the bird's welfare.
Balance
The remaining purchase price must be paid in full before the bird is released to the buyer, unless otherwise agreed in writing.
Buyer Responsibility
Upon transfer of possession, the Buyer assumes responsibility for the bird's care, housing, nutrition, supervision, and veterinary needs.
Living Animals
The Buyer acknowledges that birds are living animals and may exhibit individual behaviors, temperaments, and characteristics that cannot be guaranteed.
Representations
Representations regarding a bird's age, sex, species, and health are made to the best of the Seller's knowledge at the time of sale.
Entire Agreement
This agreement constitutes the entire understanding between the parties and may only be modified in writing signed by both parties.
Bird Sales Contract
A Bird Sales Contract will be completed and signed by the Buyer and Seller as applicable.
